hey nice to see so many buyers here..I bought a unit I think a year plus ago..i see the price is reaching 200 k, that's not bad at all. I bought a unit corner at Block B-17th floor. My fren who bought Block A has already had a chance to view his apartment and has got his keys! I can't wait for my time.Yunus the sales guy says by Mid year 2009 we should be able to move in after the extensions..

Sri Kristal owners,
Just my 2 cents opinion, would suggest you to seek legal advice from yr lawyer. This is the first time I heard the developer handed out the key but not allow the owner to view the unit. Then, why giving out the key to the owner in the first place. What is the legal implication.

handed keys, ie vacant possession is to meet the stipulated time frame, ie 36 months from SPA date (under schedule H). else, LAD incurred. but, developer has no right to stop buyers by viewing the units.

That's the possible issue. The moment you have taken the key, consider vacant possession. The developer can get away with LAD. The issue is not developer stop the owner from viewing the unit but entrance has been blocked or not yet ready. Then, how the owner can view the unit even key has been handed over to them.

I think we only can view our unit after OC obtained which is on this coming month end. Once OC obtained then consider as vacant possession. I have fren work in Farlim Group, as she told me that, they dont encourage to let owner to view the apartm now bcos is under construction for Block B and the lift is yet function. Hopefully we can view our apartm on Dec, by that time we have start to pay maintenance so they have no rights to block the main entrance. FYI, the extension will be started from 23 floor. so, which owner is lower level have to wait for longer.

VP & OC are totally 2 different things.

Once VP obtained, meaning everything including sewerage, roads & drains, water & electricity supply are ready for connection, etc.

Thus, curious that lift is not yet ready when they handed keys? Btw, maintenance starts when VP obtained.

Buyers of Sri Kristal, check your SPA date, is it still within 36 months if they don't hand the VP as what they have done now?

i believe you guys are talking about the progress for Blk B. i think 36 mths period is based on when you sign your S&P. it start counting on the date of your S&P. But i think Farlim will manage to meet the deadline (for most ppl). fyi, Blk A obtained VP & key and yet residents are not allow to go in to view their actualy unit. Reason given is project side NOT allow, all sort of reasons given. Vy disappointed

I think u can get more information from this website http://hba.org.my/forum/ where alot of issues like vacant possession and stuff like that are discussed.

My understanding is we have the rights to view the unit but not stay in them until CFO is approved. They have no rights to barricade the front entrance to the road, else how do we do inspection?

What extensions do they mean? I believe is the upgrading/renovation to extend it as per unit layout. But if u take a look at the upgrading vouchers that they gave, renovating and upgrading can be done only after CFO is approved.

If CFO is approved, means u can stay at the unit.

You're right. Once VP, basically you are fully responsible for your unit, including fire and theft. You have every right to access your unit, bcs ur 18-24 months defect libility start counting 14 days after developer issue VP notice.

The upgrading/renovation clause after CF only apply to buyer, but normally developer're not restricted. Very common for penang apartment/condo.

Conclusion, you have every right to view your unit.

Hi guys,

Another issue to bring into attention is that the notice of vacant possession sent by the

Farlim office.

It stated that enclosed with it is the Architect's Certificate indicating that the Stage 3

development has been completed but there is NO attached letter of confirmation from

Appropriaate Authority certifying that Form E has been submitted by the Vendor, checked and

accepted.

Form E need to be submitted by the Vendor for application of CFO.

If you read the S&P, on clause 31. Manner of delivery of Vacant Possesion it will state the

criteria to be met for vacant possesion :

- water and electricity are ready to be connected to the Unit.
- Vendor has applied for issuance of CFO
- an Architecture's cert that all conditions have been meet for applying for CFO.
- letter of confirmation for Appropriate Authority certifying the Form E has been duly

submitted by the Vendor, checked and accepted by Appropriate Authority.

If this conditions are not met, then the vacant possession is invalid.

The date of vacant possession is important because all charges like quit rents, rates,

taxes, assestment, maintanenance fees and sinking funds will START from this date and be

borne by the Purchaser.

The LAD will be calculated based from this date (if any) as well defect liability period.

The problem is also that when collecting the keys, the developer did'nt collect ANY payments

such as (1 month deposit + 3 months adv.) maintenance fees, sinking funds on the day of key

collection. Even if developer didnt collect the fees, it doesnt mean that the fees have not

been imposed starting from VP.

Hi Jin, this is silent 'culture' in PG!! This definitely the worst and sad issues for all house owners in PG!! Yet, the authorities seem doest not take any actions against them. Just let me 'bully' us :(.

Hi I'm the owner of Block 8-11 type D facing penang hill, already got my key but not allow to view the unit until extension work complete. but i did enter once with my parent the swimming pool is quite big and all facilities are not bad. i took the photo as well. from what i understand Farlim will appoint few contractor for us to choose from. one of them are Lip Way Decor. I had no choice to go for lip way decor, its long story.

OOI, the property is on freehold land. land owner is Khoo Kongsi. after subdivide the property, Khoo Kongsi will transfer the property to the purchaser by Memorandum of Lease (Pajakan) instead of Memorandum of Transfer(MOT).Your name will appear as 'penerima pajakan' in the strata title, meaning that khoo kongsi lease the land to you for a 99 years. now many banks (include Bahagian Pinjaman Malaysia) will not approve housing loan to Farlim project due to this Lease issue

Honestly, don't trust Farlim projects. Just look at the other older apartments and condos and you can tell what kind of service to expect from Farlim. The constant floods and jams are 2 other negative points.

The main contractor of Sri Kristal is very lousy, everything done half way, paint also half way, their works were all very rough. Beware of an agent from Khoo & Associates Realty, he delayed whatever that he had agreed to do and in the end he did not do what he had said and changed what he had agreed. We had to pay extra for what we were not supposed to pay. BEWARE!
