One scam after another. What else would they think off next? FOC is Free Of Charge and which part of it do they not understand?
Just do the math, for each unit they will be accepting an average of RM250 as i do not know how many access/touch and go cards are allocated to the Penthouse owners. We are looking at a sum of RM97,500 as deposits.
The best part is that for the replacement of any loss cards, you are being charged RM100. Thus what is the use of the deposit then? To keep and play masak masak?
As Zing's example of a TV, the remote control comes with the purchase and no deposit is asked for it but when it is spoilt the logical thing to do is to purchase a new one. You dont feel cheated as no deposit was given earlier. This is called FOC my fellow neighbours.

deposit and charges are different. deposit is something you can take back when you return the card but charges will just gone like that.

The purpose of deposit I reckon is to "remind" the people must take care the card.

If you read the booklet, there is a charge for the replacement of your cards. It is the RM100 that reminds you of taking care of your card and not the deposits. We all understand that deposits is something which you are able to claim back.

I bet you will jump if your deposit for the renovation work is to be kept by the Management and will only be returned when you sell your unit. Or its just to ensure that the unit owner takes good care of their own unit?

I don't need the reminder to take care of my own house access card. Access card is just like our house key. Who the earth will not take care of their own house key? If I lost it, I know I have to pay the penalty to get a new card.

Cost of the access card only USD 0.20 per pc, this is just a normal access card which is unprogrammable. If you purchase a programmable card, the cost is USD0.70 per card. Bolton try to make money from everywhere, which is really unreasonable. I won't buy any future Bolton project.

In regards to the modification to the existing foyer design, the Bolton mgmt office provided me a drawing last weekend and told me I have to submit it to MPPP for approval before I make changes to it. Well, I went to MPPP (Komtar 14th floor) this afternoon. The officers there told me the drawing given by Bolton cannot be used. They have asked me to engage an architect to come with a “proper” drawing. Also, I have to show that the foyer is mine and not a common area - should be easy to prove by showing them my S&P agreement. But, all this sucks as it will cost me time (I’m trying to move in asap) & money (architect is not going be cheap). And by no means it’s guaranteed that the permit will be approved.

My ID and contractor are shaking their heads because in the first place, they do not think I need a permit because the foyer is within my area. Rightfully I should be able to do anything I want to it. I am sure most owners are considering making changes to the foyer.

I cannot imagine every owner individually submitting their plans to MPPP for approval, MPPP will go nuts. I think Bolton should step in ASAP to help apply the permit for all based on one or several alternative foyer designs. Else, this will just delay people’s plan of moving in.

I concur with Hairy. The drawing that Bolton gave us cannot be used to submit and we need to get an architect to draw up a formal plan. There are three ways that I see can be done here -
1) Get an architect to draw and submit the plans. Might or might not get approved
2) Form a Joint Management group and submit the plan at one go. Might take time to form group, approval etc
3) Break down wall now without the MPPP approval, just write in to Bolton mgmt office that owner takes responsibility. Might get into problems with strata title in future.
Anyone else with ideas please give your input. I do see ppl taking the 3rd option and is already working on breaking down the current foyer wall. I am also wanting to move in ASAP and am pondering that option.

Some units have started foyer renovation. I could hear the noise last Saturday from my unit. I was told that no local council approval is required as long as no owner complains about said renovation.l Just do it!

My opinion regarding the 3 Options you mentioned:

The ID and building works people I spoke to are all saying the MPPP permit is not necessary. They assure me if you go to other condos you will find lots of people making changes to their foyers without any approval from MPPP. However, the fact that Bolton has repeatedly notified all owners (written & verbal) to remind them about getting the permit makes me really uncomfortable with Option 3. I am surprised you are saying there are people going with Option 3 because the Bolton mgmt office has told me earlier that they are not going let me do anything to the foyer without a permit. Option 3 is out for me, far too risky. It is truly disappointing that Bolton is not helping at all.

Option 2 is probably the best. But as you pointed out, to form the joint mgmt group will take some time. And, if you want to move in quickly, say by mid of this year, I don’t think this is going to work.

So, I am checking on Option 1 right now … wish me luck.

Hairy - I met up with Bolton last week to collect my access cards and was confirmed that you just need to write in a simple letter noting that you will take responsibility for all liabilities due to the foyer extension and you are good to renovate, hence the renovation that some are currently doing right now. I am actually more worried about the strata title that might get affected and putting up the house for sale in the future might be an issue. However, that being said, I am actually going in favour for the 3rd option as most will take the route, unless option 2 has been initiated. I am going to the Bolton office today and double confirm everything again

For those who think about option 3 please stop at the moment. I have given STOP WORKING by management today.I am the one who using my unit as a showroom.
I will take the risk first see what will happened so for who thinking about option 3 please stop because tomorrow Mr Satar and me will go to MPPP, will up date you all what should we do the next step.
Mr Satar is a good guy he have try his best to do his job but many problem are created by Bolton KL such as collect deposit for all the cards, as we can see that is a word FOC in the letter that we sign.

In the SNP under SECOND SCHEDULE COMMON FACILITIES AND SERVICES no.5 Sky Decks. Who know where is this?
One more problem is the common property plan building C, roof Level is totally different with what we can see now .

Finally, somebody from Bolton is helping out. But, I guess Satar has no choice as this situation is just waiting to explode. Let's face it re-doing the foyer is top priority to most owners.

The officers at MPPP will probably still insist that you submit the plan from your architect for approval. They will play safe. Hey, what do they got to lose ... submit and see how-lah. But what really is the issue here ?. If you can prove that the foyer is not a common area and belongs to you (S&P and Satar from Bolton to back up), shouldn’t it be enough, end of story ?. If that's the case, why should you even waste time & money to engage an architect to draw the plan ?.

I couldn't ask anyone from the management office as it was closed when I went there. But as James mentioned, best we wait till the confirmation from Mr Satar and MPPP. The skydeck I believe is the swimming pool area. The roof level is different as the gym was originally designed to be one floor below the swimming pool but due to space constraint, it's up on the same level as the pool itself. James, please let me know the outcome as well, I was there when you passed me your business card 3-4 days ago :)

Dear all owner I have when to MPPP this morning with Mr Satar. From the building department they said all the extension must come with plan but this plan must be ready by Bolton not us because most of us want do it.
If we go by ourself we don have a master plan to support our extension.
So now we have to firm our JMB to talk to Bolton because with my own voice is not enough.
The showroom at 3-7 is already exten out with plaster board that mean Bolton play the fool to us. Actual unit is totally different with the showroom.
Than I call up a sale person to ask him about the extension, do you know what he tell me? If the management said cannot mean cannot lo. And I ask him before I purchase you can do the extension? And the answer is : you write a letter to HQ lo.Fxxk what is this now everyone is try to cover his own backside .

Maverick, there is another unit which the foyer already been extended. It's unit 3-8. I think the work must be carry out by the contractor with Bolton consent, or else how the he'll he can extent them. I mean physically already extended even before get OC and VP. We can take this to unit as example to lodge complaint against Surin management.

This Paul fellow may seem to be the one creating all this problem. But really, the order to carry out all this nonsense has got to come from Bolton top top mgmt.

Bolton is finding to ways to recoup the money they have to pay the owners for the late delivery penalty. Their earlier foyer extension offer/scam was one of them. If it worked, they would have saved 3 months in late delivery charges and at the same time made lots of money from it. They were hoping their excuse about needing a MPPP permit for the extension would scare us in accepting their offer. Unfortunately for them, nobody took up their offer as it was ridiculously stupid. But because they mentioned the need for a MPPP permit earlier, they are now forcing us to get one. In other condos, if you need to do a similar extension to the foyer like ours, you would just have to seek permission from the mgmt office - easy. In Surin’s case, now with MPPP getting involved, it is becoming a big mess.

Common Bolton, please come to your senses. Resolve this problem before it gets worse. Your approach has been wrong. It is not doing you and all the owners any good.

MPPP nowadaz are extremely strict. if they found out, they'll compound right away. Of course, tearing it down is a must, even though you agree to submit plan by then.
They'll get a contractor to tear down for you if you refuse and charge back to you.
After that, if you still want to reno the foyer, submit plan again.

So, don't take risk. Unless you can assure that ALL in Surin do not complain to MPPP. If one person complain, that's it. They'll surely come.

Cost of engaging an architect is normally RM3K. On top of that, still need to pay very little compund fees and that's charged by square feet. if foyer, should not be more than 100.

but they inform when you inquire abt the property. not even reach SnP stage yet.

for this case, it's clear the developer has setup a trap for u. this is extremely important point and developer should not skip informing you before purchase. however, they have protected them by putting it in SnP.

how many people will read all fine prints in SnP? it's really a cunning trick be developer.

Bolton is indirectly asking MPPP to investigate itself for renovating its show apartment. What a stupid public listed company! We should highlight its stupidity in national newspapers so that its shareholders would sell off its shares!
If Bolton will just apply to MPPP for foyer renovation without making any formal compliant, MPPP will not receive any compliant and may just write to Bolton stating that no formal approval is needed from MPPP, thereby resolving our current problem.
What can Bolton gain from victimizing one owner? In the long run, this will damage its reputation in the property market! In the end, one would query on the intelligence of its directors!

I was told that before we can commence our foyer renovation, we need to obtain the strata titles for our condo units. When u do a title search at land office, u'll be surprised to know that CRM of Bolton has not submitted any application for our strata titles. I would therefore urge all owners to bombard Bolton with queries and compliants via Bolton's website, www.Bolton.com.my, by clicking under CONTACT on why Bolton takes such a long time to submit said applications. Meanwhile, we should form an owners' management committee which will then meet up with Bolton management to devise on the best way of getting MPPP to approve our foyer renovation and any subsequent renovations within our units.
There is no point of fighting against Bolton management. We need to work closely with Bolton management as MPPP's building department will only discuss and approve plans submitted by Bolton. Once such plans have been approved, the individual owners can then submit their plans based on pre approved plans from Bolton.

Went to see an architect firm today. Hoping that they could draw up a plan for me as I wanted to proceed with Option 1 mentioned earlier ASAP.

Told them that Bolton requires us to get a permit from MPPP for the foyer renovation and that MPPP wants a proper architect drawing. The architect said forget it. According to him, first of all, Bolton has to get their surveyor to make submission to the authorities for strata title application. This has to be done 6 months upon OC. After it has been submitted, the authorities will go to Surin to inspect the units. Right after this inspection (no need to wait till strata title has been issued), we can go ahead with our foyer renovation subject to approval by the Bolton mgmt office. Or, if our committee has been formed by then, it needs to be approved by the committee.

That’s really it.

This is my understanding. If I got it wrong or somebody has a different picture, please let me know. To move forward, we have to get Bolton to go ahead with the above ASAP if they have not done so.

Coming from KL, and Surin being their first project, Bolton is clearly unsure about the procedures in Penang. It is more stringent here than KL. That's why they have created so much confusion.

Hairy, after the submission of the strata title, we can't go ahead and do the extension as Bolton insists that we require approval from MPPP to do so. Therefore, we still need the approval, then only can we start the renovation. Whatever option we choose, it looks like this might take some time (at least 3 months), so for my part, i will start renovating the rooms and bathrooms and leave the kitchen as it is right now. No point for us to go banging against the wall. However, we can and should start a joint management committee(which I believe James have done so)and pressure Bolton as one voice in getting the approval done ASAP. No need to go to MPPP and do single submission as that will fail and MPPP will be more stringent for such future applications.

I was told that once Bolton submitted the strata title application, the appropriate authority will then inspect the units. Bolton can then submit the proposed foyer renovations to MPPP for approval. Once those plans have been approved by MPPP, individual owners can then commence renovation by submitting their renovation plans based on pre approved layouts made previously by MPPP. It's therefore important that Bolton submits the strata title application in a timely manner.

AL is correct in his statement. Hairy, the info came from Tommy Ang himself, the CEO of Bolton which we met last Friday afternoon. He even committed to give us buyers an update a month from last week on the progress of the strata title submission, so I take his word for it. However, like I said, we don't know when the whole process can be completed, and I think it could take some time.

Architect appointed by MPPP just came to Surin and he said that Bolton have to give us a letter that their approved us to brick up the wall with another letter by sign by the land owner and us.
Now more thing that we have to do to get the approved letter from MPPP !

If land owner is Bolton, why does it need to countersign on its letter? This looks like a simple process! Don't u think by getting politician's involvement may complicate the existing problem? i called up the fettes residence office and asked before, the office said that they already got permission frm all relevant authority right after FR got o.c.
So why don't Bolton just do like IOI???



PLUS, fyi, the studio in FR, the extra 600sf is not even stated in the S&P as accessory parcel, but just stated as 'common area...for the usage of (that particular unit)'...
n here, ours is stated in the S&P n we still have to go through all the red tapes n procedures???

I don't know how true is that I heard from a reno guy.

IOI has done the application for the foyer reno during the construction so they have no issue of extending their foyer. (My sis has bought an unit)IOI is familar with the MPPP procedure so their buyers have no headache for this.

However, Bolton is not familiar with the penang procedure. They are from KL, KL can use one way to solve this prob. U guess what? $$$

Just called up the office n ask, been informed that Bolton is in the process of applying on behalf of the residents, without any extra costs. BUT need time for approval, they say most prolly within three months.

Clarification frm the office, no extra deposit for any extension of foyer, apart frm the 2k renovation deposit which applies to every unit renovating, n which is refundable.

Only thing is that prior to getting approval, any extension work in progress must stop.

I know the foyer is not under their S&P. So my sis does not need to pay maintenance fee for the foyer area. And they have got the permission to extend the foyer.

Our foyer is stated in SPA and we have to pay service charge for it! IOI is bigger with larger capitalization and longer in property market than Bolton! Obviously, IOI has more experience in dealing with government authorities than Bolton. By right, Bolton should delay charging service charge since it is responsible for current delay in getting MPPP approval by not submitting the strata title application in a timely fashion!

in my humble opinion, i'd rather the foyer be stated in the S&P, even though i have to pay maintenance fee for that.

cos there might be problem when the strata title is being issued in the future, e.g. fettes residence. the 600sf, to be included in ur strata? or not? found out from some sources tht if u insist (u can alwaz apply) to have it in the strata, u may have to pay by per square foot.

In fact, buyer from the subsales already paying for the 1600sf, that is, the 600sf is already included in the sub-selling price. so u may not have to pay for maintenance, u may only get 1000sf in ur strata.

i;ve read the S&P of the FR studio unit, it only includes the 1000sf, that 600sf extra is not even accesory parcel of the unit, but just 'common area...' for the studio unit's usage. Even so, some (other units) may argue that they have rights to use the so-stated 'common area'.

so, if u purchased frm the developer, i.e. first buyer, u've got nothing to lose if anything happens in the future cos u only pay for 1000sf, the 600sf is an extra. BUT if u're a sub-purchaser, i would be worried of the strata, cos the sub-purchase price is for 1600sf.
SO, that is the reason so many studio owners wanted to sell their unit in FR when they first got OC...cos huge profitssss...

Per my understanding, the strata title issuance may be delayed if the actual size is diff from the SnP and there will also be additional charges ie higher stamp duty.

When to 3-7 and 3-8 today and see Bolton is ready to take down the extension for this two unit. If Bolton is doing owner of this two unit can take legal action to Bolton because OC already obtained and key already pass to them .
STUPID BOLTON try to do this because this two is a show unit with extension.

Dear all, as advice from my friend whom faces the same difficulties as us on our approval on the extension of the foyer. If Bolton did not give us an satisfaction explaination or a solution on the foyer, we can claim back our sinking fund and the mantainance fees. We can claim depending on the months of delays.

To add on, I wonder Paul Richard house or apartment he live in has a grill install inside the foyer? What a stupid idea! If I and my family members were to lost any shoes, I will definitely claim from Paul Richard. Wonder how his brain works.

There is water because the management turned on the water supply for the units which has already started their renovation works. This is also mainly because they are still unable to obtain the water supply request form from PBA. You still have to submit for your Electricity and Water supply on your own.

Went over to Surin Management Office again today and it is confirmed on the stupid grill gate issue. Spoke to Balan and he told me that Bolton is currently applying for the grill gate plan from MPPP and is estimated to take about a month. Not sure how true this is but we would just have to wait and see.
One crap after another from the higher ups in Bolton. They should be shot dead. Maintenance is paid even for the foyer and yet i am not allowed to build up my grill gate at that area. Such utter bullshit!!
One more thing to add would be that the water supply form is still not ready. Apart from that, for owners who wants to seal up the open gap at the foyer and washing area with windows, they must adhere to the proposed design from Bolton which is the Caspian Design and not any sliding windows. No tinting is allowed as well.

Tommy Ang the COO (surely stands for Cheat Operations Officer) said he will do something. But up to now, we do not have anything in black & white from Bolton on how they are going to sort out this mess. The Bolton pile of shit is getting higher & higher. This latest thing about the grill door is so damn stupid.

All the Bolton staff in Penang are all damn useless, you go to them for help and they ask you to write to KL. They must really love their jobs !

Since the meeting in McDonalds last week, I believe the team has written to Bolton to voice out our complaints regarding the foyer extension. If we do not hear from then by the given dateline, let’s formulate an immediate action plan. We should hire a lawyer and seek legal advice, let’s whacked them hard - not just on this foyer issue but all other matters as well.

On the window at the foyer and washing area, we are allowed to build up but only with Bolton's predefined design for each type of unit. The windows can only be of the Caspian Design (which opens out) and no sliding or tinting is permitted at all.

From now till the next meeting, let us individually asked around to find out what can we do to resolve this foyer extension issue. Talk to your friends who are lawyers, architects, developers, politicians, people who works in the City Council, Land Office etc. about this matter. So that, when we meet up again, each of us would have hard facts which we can go through together in order to ascertain the proper action to take. It will be more efficient this way.

I believe that the reason for Surin management restrict us from extending our respective foyer is because of the Block A. If we were to extent our foyer, it will affect the OC for to Block A as when MPPP will compare the layout for Block A and Block B.This not the reason for them to restrict us from extending our foyer as the Bolton sales team did mentioned to us that we can do it after the OC obtained.

It's been 1 months plus and we are still waiting for the PBA forms, enable us to apply the water meter from PBA. This is not a proper VP hand over when everything is in process.

By right they are not suppose to handover the keys to you until both blocks are ready.

I don't see how they deem the place livable with on going construction on the other block.

Bolton knows that they are running late and they are cutting corners so that they don't have to compensate the buyers so much for late delivery charges.

I just got an update from MPPP councillor that the extension of the foyer wall can only be done once strata title has been obtained. From Bolton's COO Tommy's comment is that Bolton will submit the extension plans to MPPP once MPPP is done with the measurement and proper plans for strata title has been completed. It looks like at least 3-6 months time before we can do any renovation to the wall. I am also not sure if a Joint Committee can be formed without obtaining the strata title as Bolton management has full say since they still "own" the development, not the buyers. Correct me if I am wrong on this.

Are you saying, to do the foyer extension, we have to wait till we get the strata title ?. Or, we can proceed with the extension after the authorities has done with the measurement/inspection ?.

As I know, within 6 mths after OC, Bolton has to submit the strata title application. Then the authorities will come to do the measurement/inspection. How soon will this inspection take place after the strata title application has been submitted is not known. Perhaps maybe within 3 mths – depends on the authorities. Btw, don’t think Bolton has even submitted the strata title application yet.

If we have to wait till we get the strata title to do the renovation, it is not going to be 3-6 mths from now. More likely 1-2 yrs at least.

I am echoing what the COO mentioned that Bolton will submit the foyer wall renovation plans to MPPP during the same time when they submit their strata title application. I am not sure whether is his words accurate, but he will give us an update end of this month on the progress. Anyhow, let's meet this coming Saturday as what James proposed, to firm up a joint committee so that we can at least move forward in one voice rather than putting our hopes on something that may not materialize.

Dear All,

What I know from the Surin Mgt office is that they asked us to apply from the foyer extension ourself from MPPP, orelse it might takes 3 to 6 months. This is because they have to apply together with Block A.

They also tell us to go through our building architect which is East Design and our Surin Mgt will give letter of support stating that this parcel belongs to us. This way its much faster to get approval rather than wait for Bolton to apply.

This is not fair to onwer of Block B as for Block A when their unit is ready, means they can start renovations as soon as they get their keys. We any how need some compensations from this delays by Bolton which created so much hassle for us to go through and delays means waste of time and money.

What do you guys think?

As I was outstation, I was unable to attend said meeting on Saturday. Kindly tell me what was agreed or proposed to resolve our foyer problem.
I had received a letter from Bolton recommending that I contact the MPPP officer directly regarding the procedure and approval for our foyer extension. It appears to me that Bolton is trying to wash their hands so to speak. Its latest recommendation differs from what Tommy Ang had recommended to us recently. I was also told to contact East Design Architect regarding submitting and liaising with MPPP officer on approval of our foyer renovation. However, when I talked to East Design Architect, I was told that the owners of Surin condos can never use the service of East Design due to conflict of interest as Surin had hired their service.
U had previously met up with the Tanjung Bungah' state MP, may we know the outcome of your discussion.
