Single mum risks losing condo over RM14,000 debt

A single mother of two is in a quandary as she owes the management committee of her condominium RM14,017.20 in outstanding maintenance and sinking fund fees, and interest.

She faces the prospect of having her unit, which she bought for more than RM400,000 three years ago, being auctioned off.

Lisa Nadia Tan Thuan Li, 35, a factory manager, said she could not afford to pay the amount in a lump sum as she has two young children aged four and seven as well as an aged father to support.

“I had issued them 17 postdated cheques for the fees but these were returned to me,” she she told a press conference at Batu Uban assemblyman S. Raveentharan’s service centre on Tuesday night.

She said the quarterly fees were RM734 for the condominium in Gelugor here.

Tan said she had been unable to pay the maintenance charges since Jan 1, 2009.

On Oct 25, the condominium security barred Tan’s car from entering the parking lot due to the outstanding amount.

She responded by parking at one of the condominium’s entrances.

Both sides lodged police reports regarding this incident.

Tan claimed that a large group of people including 10 policemen came to her condominium unit last Sunday at 8.30am.

“The management committee took inventory and photographs up to noon while the police remained outside,” she said.

When contacted for comments, the management committee said: “Please get the comments from our lawyer.”

The lawyer, who declined to be named, said Tan now had 14 days to pay up failing which the condominium unit could be sold through public auction. - By The Star

If I am the security, I will direct bar her car after 1-2 months of non paying the fee, the security there is so kind to let her park for 10 months before barring her car.

Please lah, got money stay in 400k condo dont have money to pay 200+ maintenace fee? If everyone also like you, where the hell to find $$ to maintain the condo???

There are a lot of jokers like this out there, able to buy few hundred K or even million dollar condo but refuse to pay few hundred of maintenance fee, please do your part, instead of blaming others!!!!!

Well done management committee. Can't afford can sell this condo and stay at apartment with lower monthly maintenance fee rather than enjoying luxury environment without paying anything. If everyone same as her, where to get money to maintain the facilities.

I am feeling sorry for this lady, has to face with this tough situation and at the sametime to take care of 2 young children and aged father. However putting the sympathetic factor aside, I fully support the action taken by the management against the defaulters. I am not particularly referring to this case but in general, there are bunch of un-scrupulous strata owners reluctant to pay mnt fees on purpose, and at the same time still enjoying the facilities and even make earnings when renting out the unit, all these come in the expense of others whol diligently paying thier fee each month. Message to Palm Palladium(?)management committee, Good Job Done, I wish the committee in my condo can be as gutful, persistent, and effective as you do. However whatever you are doing, pls ensure that it is following the right protocol, and abide to the law.

The lady should seek help from the welfare organizations if require any financial aid. Personal reason is always not the good reason to default on the mnt fees. I also wish to save on my current mnt fees so that i can but more toys to my baby and give more pocket money to my parent, but again, this is not right.

Guys, it's Bayswater Condo. I knew the case as I stayed here. She is well deserved for the punishment, she is extremely rude and inconsiderate. It is not correct as claimed she is poor, she has a maid at home too.

I fully supporting the action take by the management of Bayswater. Over the past 3 years, we had changed 3 management team, and this is the BEST management team that we ever have. They are doing a very good job. The approach that they adopted to block those owners who did not pay the maintenance fee from driving into the condo, in fact, we should also block them from entering into the condo.

Well done management team, we fully supporting you !! Good job and keep it up !! We are always supporting you !!

Well done management! Sounds like this lady is not a simple person when she deliberately parked her car at the entrance to obstruct others when the management block her car from entering the parking bay. If she don't pay to up keep the parking space she has no right to use it. Many owners are like her. Never pay maintenance but get aggressive instead when confronted. They deserved to be vacated and sent to court. You owe you pay. Let this be a warning to others like her too.

I don't know the lady, so I can't really judge. This is the first time I am hearing that the property manager can auction your property over unpaid dues. Is this legal? I know of banks auctioning if you can pay the loan, but monthly maintenance fee?

Well done, Bayswater management. You did the very right thing and others should look at you as the role model. The management of the 2 condos which i previously stayed choose to do nothing against defaulters, eventually led to cashflow problem and resulted in poorly managed, run-down building and facilties. At the end, they decided to increase the mnt fees, and also introduce sinking fund. This was somewhat a desperate and stupid measure but there was no choice then. Clearly the winners still those defaulters who manage to laugh to the end at the others expense.

Anyway, the lady in this case definitely not in the difficult situation as she has claimed. Whoever bought an unit in bayswater with ~400k should be at least making >150k now. She is probaly richer than many others normal penangite currently. She just has to show some sincerity and walk into any of the bank and ask for re-finance or loan top-up (to avoid penalty if lock-in not over) and the case is close.

When judgement obtained, the court can sent baliff to auction whatever items in the unit to recover the debt. Many ppl thought that management co unable to do anything and just dont bother to pay. The lady deserved it and she should be ashamed for living on other ppl charity since 2009. Management should implement access card system to the lift and barred her as well!

Fully support KS_Rev and Coll point of views. The management did the right thing against the mum who is reluctant to pay maintenance fee but still want to challenge them by parking the car at the entrance which cause trouble to all owners and tenant at that condo. In my opinion, if the mum think 'win-win' by arranging installment be it 17 or 70 post-dated checks by taking the ego apart instead making a big huh-hah and ended up still have to pay up the debt in a more painful way (may even have to pay more by engaging a lawyer). Hurray to Bayswater management for setting a good reference to all property management companies, JMB and MC for all strata properties in Malaysia.

Tim,as I mentioned earlier, Bayswater went through 3 times of changes for their management. The previous 2 was really sucks ! We cannot blame the current management team for the late action as they have just took over the property management less than 1 year ago. I can see that there are so many outstanding items have been resolved such as the frequent breakdown of carpark lift, the mulfunction of intercom, the car entrance card access reader problem, the control of outsiders getting into the premises enjoying free swimming pool, all the problems have been arrested now! This is called World Class Property Management team !

I am fully agreed with Bp comments, we should deter those who refuse to pay the maintenance fee from getting into the premises. Else, those who are paying the maintenance will be funding those who refuse to pay. At the end all of us need to pay higher maintenance cost. We must get rid of the bad apples and let the tree grows.

She sound a real inconsiderate, unreasonable and shamelessly believe she is being victimized. Yes it's bad to be a single mother of 2 and she has to support her old dad but there are countless less unfortunate then her but has lived a righteous life without resorting to cheating, lying and owing money.

Since she bought this condo 3 years ago. I am sure the value of her condo has appreciated. She can easily sell it, make a small profit, pay her debts and move into a more affordable condo.

It's hard to believe she is ever poor considering she's a manager, has a car, own a 400K condo and hires a maid. That makes her a low live liar too.

Noticed no one feel sorry for her here. I hope the management will kick her out.

fyi... there was traffic build up because of her. there is only 1 entrance with 2 gates & she blocked 1 of the gates

was also told she did not pay the maintenance from day 1 she bought the place more than 3 years ago, yet she does not dress or look poor

i agree with the comments that i'm shocked that she can be so arrogant to take this matter to the assemblyman! and to the press!

she refuses to acknowledge that she is behaving incorrectly in communal living - this is not a house and residents need to play their part in contributing to the well being of their hard earned homes

Whether she is a single mother or has 100 people to support is for her to manage. She should not heap her problems on others. Rather, she should live by her means and find a place suited to her budget. Anyway, she has made 200-300k profit already and yet, not willing to foot the RM240 per month fee which translates to RM8 per day - that's not hard to put aside, is it?

put simply, she is a parasite who feels that the world owes her. sorry to be mean but i agree with Maverick that perhaps she's single mum for a reason

I was also told that she is very LCLY.....I am sure all the residents in Bayswater supported the management which protects the well being for all of us. If this is case is not resolved properly, it will afect our property price for sure. So, let's continue to give her a thumbs down and continue to pressure her to bow down.

In my country, mass market residential set up needs to have clear rules and laws with ability for strict action.

Penang is a lovely place but I see rules are not usually followed. To move from 3rd world to developed nation requires a mental shift and the conscience effort to be civic minded. I spent time observing the New Year 2011 celebration and shocked at the amount of rubbish thrown around.

If foreigners can fall in love with this place why are locals abusing it? Malaysia is still 3rd world and your vision of developed nation is in jeopardy unless there is collective thoughts and effort to bring about progress.

Applause to the Management Committee.

This is voluntary work by the elected residents and they not even paid to do the work.

More often than not, they actually get threatened and some committee members I know even got their car scratched regularly due to disgruntled residents.

Staying at Bayswater, one of the hottest property in Penang and cannot afford to pay maintenance ?

Come one, this "single" mum, a factory manager at that, are just play-acting for sympathy.
In fact, I would say, she is "tak tahu malu".

denying a resident his/her right to use the carpark or his/her UNIT is a blatant violation of the owner's right even if he /she is late or not paying the management dues
the flat/parking DOES NOT belong to the management company-it is the personal property of the owner -you cant just locked/sealed the gates /cut off electricity or water supply as widely and indiscriminately practised in this country.
the management as they rightly did in this case can imposed penalty for late payment and to issue ultimatum/court judgement to recoup the fees failing which of course the asset-property can be auctioned off to recover the due amount
i think she will be able to pay the 14k before any drastic action is taken against her,i just cant understand why she needs to portray herself as a victim and the management the villain when the story is a simple straightforward case of debtor vs creditor

central, owners of stratafied properties like this one are governed by the deed of mutual covenant which serves to protect the general interest. the management committee acted intra vires refusing car park entry and should be commended. the committee could not have cut water / electricity supply as that is under the purview of PBA and TNB

I dont think this lady is poor. She can challenge the MC in Bayswater to court. She is wearing branding shoes and clothing. She is only "chow kah" does not want to pay maintenence fees, sinking funds, insurance and quit rent.

Recall back that day she parked her car at the enterence blocking residents cars entering, 2 police cars came and advised her to move her car. She acted like nothting, who said she was afraid of police ? Now she told press that she was treathen by policeman on the day of attachment. Who can believe this lier.

This hardcore defaulter also said she did not pay since January 2009. Can anyone believe this lier ? The unit she stay in Bayswater is the largest unit, 1,636 sf at RM0.18 per sf maintenence. So its only RM294.48 per month. If from January 2009 till December 2010 is 24 moths x RM294.48 = RM7,067.52 only. She is a big lier.

She owes from the 1st day she moved in in July 2007 till Dec 2010 total 42 months x RM294.48 = RM12,368.16 So, plus interest, insurance and quit rent total is RM14K.

She claims she has no money to pay. She must know if she cannot affort to stay in RM700k condo, than move out to lower cost apartment. If she has no money, why she wants to " fight " with MC in court ? She think she can win this case, dreaming !!!

Dear Baywaters Management & The Lady,

This is an adult matter. Both parties need to be mindful and considerate especially towards the children living in Bayswater. You are actually causing an emotional & psychological disturbance to the children.

Please resolve the issue in a civilized & peaceful manner. This is a community living & Bayswater Management should uphold harmony & peace in Bayswater without disturbing its residents.

There is no point resorting to legal rights, actions, demands & press conference to prove who is right & who is wrong. Wasting additional time, energy & money. Both parties please take 3 steps back and resolve this. Give her the benefit of the doubt and get an agreement from her to pay all due & future maintenance fees in a reasonable duration.

It doesn't matter who is right & who is wrong. It is how you get the job done. And each job is a self portrait of the person who did it. At the end Bayswater Management will get all due & future maintenance fees as well as uphold peace & harmony in Bayswater without disturbing its residents!

There are 396 units in Bayswater. If 10% do not want to pay maintenence fees, what will be the outcome.

This lady has been issued LON, LOD since the management by IJM in 2007 yet she did not respond to the management. She has been given ample time for the last 42 months. Penang has thousands of condos and apartments, just imagine if 10% did not pay maintence like her. She is the only defaulter in Bayswater.

MC do not disturb her living in Bayswater. It was durin AGM that residents agreed to take action against defaulter/s.

Let's say she is the only one in Bayswaters that does not pay maintenance fees. And the Bayswater Management decided to take action.

For every action has an equal and opposite reaction. The Bayswater Management is reactive here and allow outside influences (mood, feelings or circumstances) to control their response. Do not corner/demand/force a person until there is no more space/room for her to move. The response would be aggression.

Start to tackle the issue with the end in mind. That is to collect all due & future maintenance fees from her. Have a plan to collect all dues without causing any inconvenience to the residence. No need press conference, law enforcement authorities, etc. Think win-win and genuinely strive for mutually beneficial solutions & agreement. Strike a balance that due & future maintenance fees must be paid and mindful consideration for her 2 children and old father.

Do not make statements to run down a person like: "Chow Kah"; auction unit; can buy 400k apartment but cannot pay RM2xx maintenance; or stay at low cost place, etc. Do not prejudge her. Nominate a Management representative to seek to understand her and her predicament using empathetic listening. This will compel her to reciprocate the listening so that she'll take an open mind to being influence by you the Bayswaters Management. This is the most important principle of interpersonal relations. Please keep them private & confidential.

Find ways to put the past behind and drop all legal suite against each other. Formulate a repayment agreement plan for her due & future maintenance through mutual trust and understanding.

The Bayswater Management can also get a neutral party to do this.

Telur, even though your recommendation sounded rational, but in this case the lady has not been paying for years. I would understand your argument if the lady has not paid for 3 months, but not paying for years is not fair for others who paid them on time. What if everyone starts not paying because they knew a case in bayswater where a resident can run from paying for years and yet the management are supposed to still be nice and work things out slowly? To be fair, from what i read here, the lady does sound like she's capable of paying, but just refused to pay.

MS on January 4, 2011 7:11PM asked for constructive suggestion to resolve this matter. I have actually read through all comments and links. So far nobody has given any constructive suggestion. I have given the Bayswater Management a constructive alternative to resolve this matter.

Take action does not necessarily means hantam, demand and/or legal action. Hash action will result in aggression. Do not wash dirty linen in public. You don't have to be hash to be effective.

What is the reason you guys come to a conclusion that she just refuse to pay? There must be an explanation for her behavior. Blatant demand is not the answer. That's why I said seek to understand her and her predicament first before jumping to conclusions.

If its 2/3 years due, so be it. She has to pay what is due. Please workout a reasonable repayments if lump sum is not an option. There is no such thing as no option or only 1 option. There are always options. You don't have to be soft here, just have to be reasonable.

Choose to make a difference from other condo management. Take effective action not hash action. Earn the respect as the best condo management across the land. Management through respect not fear. Be magnanimous in handling this matter.

She had a phillippine maid working with her. This maid disappeared after her car was stopped from entering the condo. In Bayswater, most residents hire Indonesian maid because its cheaper.

whether it is an effective action or harsh action by the management committee, i believe all sort reasonable, soft or persuasive approach has been taken in the last 2-3 yrs to recover these long outstanding prior to this drastic measures. nobody want life to be difficult as long as things can get done in simple way unless when it fails, then people shall try other better ways which may appear to be harsh.

Being a committee members is a voluntary job and most of the residents will complain if they do not do things right. Put yourself in committee members position, or being one of the condo committee members and you will know how it feels. She really deserve the legal action.

i think your claim is stupid and basically show that you hv "telur" iq and eq

the lady has been given 3 years to pay off her maintenance fee, but she fail to do so, so any harsh action towards her for now is reasonable.

the concept of condo is the "share of amenties", to do so and maitain those amenties in right shape, e.g you do not want to park your car in car park that without any light. the concept here is "shared" to keep the "cost" low.

if you think all this amenties, car park etc are not important to you, then simple, you dont buy a condo unit, otherwise please be "responsible".

owing the fees -> bad shape of condo after few years -> de-value your condo, you cant sell in good price -> nobody want to rent from you, there is other better choice of condo every where -> and you end up keep cursing and complaining MC not do a good job (lift always break down nobody repair, car park light nobody replace when blow up, swimming pool dirty, etc) which all result in "you" default the payment for many years.....

to make you bad enough, you are sacrifiying the "right" of 99% of the resident to "enjoy" the public amenties in good shape, just beacuse 1% of ppl like you refuse to do you part by paying the maitenance fee.

You have some good comments but I don't see how it works in this scenario. This lady has been given many due pay notice for years and what is her reason for not paying? Regardless of your monthly income law is law you should pay. If you don't pay monthly bill to TNB, bank loan for car or house, astro, telekom, indah water, maxis, digi and etc for years what kind of action taken by the authorities? Answer is simple they will send you an invitation letter to see you in court. The committee of Baywater residence and management has done their job and now is up to this lady to do her job.

This hardcore defaulter case is fix for hearing on 28/1/11 at Georgetown Session's Court at 9.00 a.m. Application no. 74-0202011.

Let the court decide how is this defaulter going to settle her maintenence fees from the first day she moved into her condo till today.

The outcome of the verdict will bring great impact to the entire gated & guarded (G&G)property in Malaysia.

Scenario 1 :If the outcome is, she still has to settle her debt, then case closed.

Scenario 2 : On contrary, if she won the court case and no action to be taken on her,and she is allow to drive freely and use the facilities anytime, I will be the 1st one to stop paying the maintenance fee immediately.

I am very sure 99% of the owners would like to see the scenario 1 happens and there will be 1% of the people like her who wish to see scenario 2 happen.

Rotten apple is rotten apple, let's get the rotten apple away so as to save the entire tree instead of save one rotten apple but sacrifies the entire tree.

This case is fixed to hearing on 11th Feb 2011. In her affidavits, she had seek COB, Land officer and YB to help her but all rejected her. I dont think she can escape from paying her maintenance fees she owe.

no comments on the part of the lady / resident.
BUT i have personally had it up to my NECK on the pathetic quality of service of the bayswater management office. for ONE AND A HALF YEARS (YES - YEARS! you read correctly) i have been paying my maintenance fees, BUT in the ONE AND A HALF YEARS as well the "manager" a certain Mr Soo / Su (not quite sure how the name is spelt) has FAILED to get back to me on a very SIMPLE question / request for advise.

My smarthome has a faulty remote control, and I WAITED for ONE AND A HALF YEARS (to date, and STILL WAITING)
1) i had taken leave from work to stay home to "wait for (their) phone call when the technician comes"...not one not two not three but MORE TIMES - no call came
2) i have followed up, on phone, marched to their office, stood there as they "take down (my) phone number" for the 11th time (or was it MORE?) - no news came
3) i have taken the effort to PASS TO THEM my remote control for the smart home, to see if it could be fixed, replaced or if they could advise WHERE / WHO to go to to inquire - and that was about a quarter ago? still nothing

i called them again today. And "let us take your phone number down" seems to be the standard reply it is beyond pathetic now...

bottomline - the bayswater management is NOTHING to shout about in terms of accountability. collection of fees - pronto. BUT remember now, to "advise" on a simple thing - ONE AND A HALF YEARS (and waiting) is the turnaround time is it?

Both father and daughter are scams and culprit. They stole the company of Lisa's brother Sigma Range (was at e-Gate) then set up a fake company to sell Taiwan products. They also cheated a lot of money from those who used to help them, and not to forget, she has cash amount of RM2mil loaned by bank under Sigma Range.

After the closure of the Taiwan products, Lisa worked in Chee Wah Corporation as Senior Mnaager then move to Cosmopoint College as Centre Manager, and now she is in Takasima as Corporate Social Responsibility Manager.

Another story is she HAS a Filipino HUSBAND working in PJ, that also explain why is she hiring Filipino maid. 2 kids are following Lisa but it is a pity that both kids are naming after Tan, not husband.

Her father Richard even worse, as her father is the person behind all these....
